Hi My Husband And I Just Recently Got Married He Is German Citizen And I Am American Citizen….he’s A Student


Ok so here’s the deal he has been here for 8mos or so…I just got back from Iraq was in the Army when we met in Stuttgart 2yrs ago..Anyway how long does this process take and do we need to start any paperwork so that we don’t have to renew his student visa which is really expensive? Also does it matter that my current address is in Northern California and his is So. Cal? I mean do we have to use one single address? I just want to make sure we get most of this done soon cuz’ I deploy to Kuwait in about a wk or so we just got married on the 15th of Jan…also do I need to change my last name to his to show validity of our marriage in this process??? Lots of questions I know…plus he’s he’s half German half Iranian will that have any bearing on this process, I mean should he just skip the Iranian part? I mean on the marriage license it shows his dad is from Germany and his mom is from Iran…Pls help I’m 26 & he’s 29 so we want to make sure everything goes well…thanks

    You can go to the http://www.uscis.gov website and get the form and instructions.. you will also need 4 copies of the G-325a biographical info for both you and him, 2 passport sized photos of each of you, the evidence of your relationship, copy of your marriage license, proof of your U.S. citizenship like copy of passport pages or a CERTIFIED LONG FORM of your Birth ceritifcate which can be rush ordered from http://www.vitalchek.com if you are in a hurry..
    It should take 6-10 months to get approved they are currently behind..
    I believe you also file an AOS at the same but I do not know about that because I am doing mine out of coutnry and have to do a waiver because my hubby never had a visa..
    I just filed mine it’s fairly easy.. they do ask to prove marriage but you do not have to change your name if you don’t want to.. not having the same address is suspicious but if you include a note that it is somehow due to being deployed in the military I am sure they can understand.. you will need things like pictures, sworn affadvaits of people who know you that the marriage is real.. a shared bill or lease or bank statement.. shared credit cards or bank statements.. phone records.. postmarked letters he wrote you when you were deployed? Things like that anything that proves a relationship that is real and not for ‘papers’
    OK the person above me confused me about what happens to his old visa or if it complicates your process.. um.. you should ask on the forums because I am not an expert lol

    ok…well first the marriage cancelled his visa so he is now out of status.the process takes up to 2 years.
